Your firm is invited to submit a Bid under seal to Owner for construction of the Cattaraugus Water System

Improvements. The greater project consists of approximately 124,000 feet of HDPE and PVC waterline

installation and two (2) pump stations and will be bid under multiple contracts. The Owner will receive Bids

for all contracts at the office of the Seneca Nation of Indians, located at 987 RC Hoag Road, Salamanca NY

14779, on March 11, 2024, under the following schedule:

Contract A – until 9:00 AM local standard time;

Contract B – until 10:00 AM local standard time;

Contract C - until 11:00 AM local standard time;

Contract D - until 12:00 PM local standard time;

Contract E - until 1:00 PM local standard time;

at which time and place the Bids will be opened and read aloud. Bidding Documents not received by the

indicated time will not be opened. Please conspicuously indicate on the envelope containing your bid

which contract you are providing a bid for. If a Contractor is submitting bids for multiple contracts, each

bid submitted must be in a separate envelope and be submitted at the appropriate time according to the

above schedule.

Project Description:

A. Contract A: The Work consists of approximately 30,000 linear feet of PVC pipe, HDPE Pipe, valves, fire

hydrants, interconnections, water service connections, and site restoration along Milestrip Road, Flat

Road, and NYS Route 438.

B. Contract B: The Work consists of approximately 24,500 linear feet of PVC pipe, HDPE Pipe, valves, fire

hydrants, interconnections, water service connections, and site restoration along NYS Route 438 to

Versailles Plank Road, Versailles Plank Road, Burning Springs Road, and Van Vleck Road.

C. Contract C: The Work consists of approximately 16,100 linear feet of PVC pipe, HDPE Pipe, valves, fire

hydrants, interconnections, water service connections, and site restoration along NYS Route 438 east of

Versailles Plank Road.

D. Contract D: The Work consists of approximately 24,600 linear feet of PVC pipe, HDPE Pipe, valves, fire

hydrants, interconnections, water service connections, and site restoration along NYS Route 438 east of

Contract C, Indian Hill Road and Whites Drive.

E. Contract E: The Work consists of approximately 27,900 linear feet of PVC pipe, HDPE Pipe, valves, fire

hydrants, interconnections, water service connections, and site restoration along Buffalo Road,

Versailles Road and Gordon Garrow Road.

The Copy Store at 49 Court Street, Buffalo, New York 14202, upon a non-refundable fee per set. Payment

can be submitted by credit card or company check/money order made payable to The Copy Store. Bidders

must be registered with The Copy Store as having obtained a complete set of Bidding Documents. Bids

submitted on copies of Bidding Documents from other sources will not be accepted.

Bidding Documents will be shipped from The Copy Store upon request and upon receipt of an additional

non-refundable shipping charge made payable to The Copy Store.

All proposals shall be submitted on the forms furnished herein and the entire volume, including any

addenda, shall be submitted in a sealed envelope and addressed to Joel Merrill, PE, Seneca Nation of

Indians Health Department, 987 RC Hoag Drive, Salamanca, NY 14779. The Contractor's name, title of the

proposal, and date and time of the bid opening shall be clearly marked on the outside of the envelope.

Bidders will be required to provide Bid Security according to the requirements in EJCDC C-200 - Instructions

to Bidders. Refer to other Bidding requirements as described in EJCDC C-200 – Instructions to Bidders.

The successful bidder will be required to furnish a performance bond and payment bond, each in an

amount equal to 100% of the total contract award amount.

Bids must include a declaration to the effect that the bidder is not in collusion with any other bidder.

The attention of the bidders is called particularly to the requirements of conditions of employment to be

observed and minimum labor rates to be paid under this Contract, Federal and State Clauses, TERO

Ordinance, and SNI THPO Policies and Procedures.

A fixed price Contract shall be awarded to the low bidder, who is determined to be responsible and

responsive, in accordance with Article 19 of the Instructions to Bidders (EJCDC C-200). The Seneca Nation of

Indians reserves the right to reject any all Bids considered too not be responsible and responsive. The

Seneca Nation of Indians reserves the right to waive any immaterial nonconformities.

The overall project is located within the Seneca Nation of Indians Cattaraugus Territory, with a small

portion in Chautauqua County, New York. The Seneca Nation is a sovereign Nation and is therefore not

subject to New York State laws, regulations, and/or ordinances. Bidders should fully understand the Seneca

Nation’s laws, ordinances, and standards outlined in the Bidding Documents, and as may be further

directed by the Seneca Nation.

A Prebid Meeting will be held for all contracts at 9:00 AM local standard time on February 22, 2024, at the

Cattaraugus Community Center, 12767 route 438, Irving, New York 14081. Bidders are invited to attend.

Your Bid will be required to be submitted under a condition of irrevocability for a period of 75 days after

submission. The Owner reserves the right to waive irregularities and to accept or reject any or all Bids.

The lowest responsible bidder for each contract will be required to attend a meeting with Nussbaumer &

Clarke, Inc. and SNI Health Department Staff on March 13, 2024, to review your bid. The location of the

meeting will be at the Seneca Nation of Indians Health Department, 987 RC Hoag Drive, Salamanca, NY

14779. The meetings will take place under the following schedule:

Contract A – until 9:00 AM local standard time

Contract B – until 10:30 AM local standard time

Contract C - until 12:00 PM local standard time

Contract D - until 1:30 PM local standard time

Contract E - until 3:00 PM local standard time
